It's Starting! (the "App") is operated by E&M Kazanjian, LLC ("we," "us," or "our"). By downloading or using the App, or accessing our marketing website (together, the "Service"), these terms automatically apply to you. Please read them carefully before using the Service.
1. Use of the App
You are permitted to use the App and our website for personal, non-commercial purposes. You agree not to copy, modify, or attempt to extract the source code of the App or reproduce its assets.
2. Crowdsourced Data and Accuracy
The App relies on community-submitted logs and automated parsing. We do not guarantee the precision of wait times or ticket parsing. We are not responsible or liable if you miss the beginning of a film based on crowdsourced averages or countdown alerts.
3. Your Content and the License You Grant Us
When you submit logs, ratings, comments, or other feedback ("User Content"), you keep ownership of it. You grant E&M Kazanjian, LLC a worldwide, non-exclusive, royalty-free license to use, store, reproduce, aggregate, display, and distribute your User Content in connection with operating and improving the Service, including making auditorium-level feedback available to theater operators through our dashboard, as described in our Privacy Policy. You confirm that the feedback you submit is your own and that you have the right to submit it.
4. Content Standards and Moderation
You are responsible for the feedback you submit, and you agree that it will be truthful and based on your own experience. You agree not to submit content that is hateful, harassing, defamatory, knowingly false, or otherwise abusive. We make reasonable efforts to remove content that violates these standards, and we reserve the right, but do not assume the obligation, to review, remove, or refuse any content and to suspend or terminate accounts at our discretion.
5. Your Responsibility for Your Content
You, and not E&M Kazanjian, LLC, are responsible for the User Content you submit. You agree to hold E&M Kazanjian, LLC harmless from any claims arising out of the feedback you choose to submit.
6. Offline Caching Queue
We provide a local queue to cache logs offline. We are not responsible for unsynced logs if the cache is cleared or the app is uninstalled before syncing.
7. Third-Party Services
The App uses third-party services, including Supabase and TMDB. Your use of those services is also governed by their respective terms. This product uses the TMDB API but is not endorsed or certified by TMDB.
The Service may also offer an optional link or handoff to Letterboxd. Choosing it opens Letterboxd with movie information intended to help you prepare a diary entry, but you remain responsible for reviewing, confirming, and saving anything in Letterboxd. Availability and behavior of this feature depend on Letterboxd and may change. It's Starting! is not affiliated with, sponsored by, or endorsed by Letterboxd, and your use of Letterboxd is governed by Letterboxd's own terms and privacy notice.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the crowdsourced data it provides is accurate or complete.
9. Limitation of Liability
To the fullest extent permitted by law, E&M Kazanjian, LLC will not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service, including any decisions made based on crowdsourced data, wait-time averages, or alerts.
10. Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules.
